By-LawsSec. 1 This Province shall be known as Province V of Kappa Psi Pharmaceutical Fraternity, Incorporated.
No additions to By-Law II
Sec. 1 Each Collegiate Chapter shall pay the annual per capita fee of five and 50/100 ($5.50) U.S. dollars per member, and each Graduate Chapter shall pay an annual fee of seventy-five ($75.00) U.S. dollars per Chapter. Said payment shall be accompanied by a list of actual dues paying members of record as of November 1 of the previous year.
Sec. 2 Any Chapter deemed not in good standing with the Province shall NOT be eligible for receiving any official Province award and/or recognition. This includes, but is not limited to, awards such as Chapter of the Year and the Traveling Trophy Award.
Sec. 1 The Province shall meet twice yearly. A Province Assembly shall be held each spring, and a Province Interim Meeting (Midyear) meeting shall be held each fall. The Executive Committee of the Province, after consultation with the host chapter, will determine the exact date, host facility, and program content. The host chapter shall be determined by the following rotation, beginning in spring 2007: Pi, Beta Lambda, Gamma Delta, Chi, Upsilon, Beta Upsilon, Beta Phi, Gamma Iota, Mu Omicron Pi, Delta Nu, Beta Psi, Xi, and Gamma Chi. Should any chapter decline to host the Province meeting, the next chapter in the rotation shall be the host, with said rotation continuing as previously stated. In the event that Collegiate Chapters have Graduate Chapters in close association, said Graduate Chapters will function as co-hosts with the Collegiate Chapter designated in the previously stated rotation.
Sec. 2 At all Province Executive Committee Interim Meetings, pursuant to By-Law IV, Sec 4, the Satrap shall invite one (1) member from each Chapter, not represented by a Province Officer, to attend in a non-voting capacity.
Sec. 3 Pursuant to By-Law IV, Sec 2, the Regent of the Chapter hosting the Interim Meeting shall be ultimately responsible for notifying each Chapter and each member of the Executive Committee of the agenda for the Interim Meeting at least thirty (30) days before said event.
Sec. 4 An emergency loan for the current year Province Assembly may be obtained by the host chapter from the Province funds in the manner as follows:
a. The host chapter must petition the current Executive Committee for a loan up to $2,000 to be taken from the Province funds, for the sole use of the Province Assembly.
b. The petition must be accompanied by a proposed budget for said Assembly and a minimum of 1 paragraph explanation of the need for such funds.
c. The Executive Committee shall respond to this request no later than 1 month from the date of the receipt of the written request.
d. This loan shall be repaid no later than 30 days past the final day of the Province Assembly for which the loan was taken out or the borrowing chapter shall not be considered in good standing.
Sec. 1 A Chapter in good standing is defined as one meeting all financial and constitutional requirements of the Province and Grand Council.
Sec. 2 Pursuant to By-Law V, Sec 6, one (1) registered, voting delegate from each collegiate chapter shall be reimbursed for the round trip automobile mileage from the delegate's home chapter of residence to the meeting site, at the rate of twenty (20) cents U.S. per mile. Reimbursement shall not exceed two hundred seventy-five dollars ($275) U.S. All Province officers in attendance shall be reimbursed at the same rate as the delegates. In addition, the Province Officers shall be reimbursed the Assembly registration fee. Reimbursements must be approved by the Executive Committee. The Province Supervisor shall have the assembly registration fee waived, and may be reimbursed for expenses other than travel, consistent with policy established by the Executive Committee of the Grand Council, and with approval of the Province Executive Committee. Said payments shall not be used to reimburse Graduate Chapter delegates for expenses incurred for traveling to and/or from Province Assemblies.
Sec. 1 All nominations for Province Officers shall be made from the floor during a session of the Assembly. No Brother may be considered for, or, elected to any Province Office unless he or she is registered and present at the time of election. No Brother shall hold more than one (1) elected Province Office at the same time.
Sec. 2 Elections for Province Officers shall be ordered in a manner consistent with the conduct of order to the Grand Office, and shall be in the following order: Satrap, Vice Satrap, Secretary-Treasurer, Chaplain, Historian, Province Parliamentarian, Webmaster, and when appropriate, Province delegate and Alternate Delegate to the Grand Council Convention.
Sec. 3 The Vice Satrap shall be responsible for coordinating a Province V philanthropy project with chapter participation between Province Assemblies benefiting a charity selected by the assembly. The Vice Satrap shall also communicate and evaluate chapter progress in regards to overall community and professional programs with each chapter.
Sec. 4 In addition to those duties pursuant to By-Law VI, Sec 2, the Province Secretary-Treasurer shall send each Chapter in the Province, at least sixty (60) days prior to the next Province Assembly, a chapter report form. Each Chapter shall submit one (1) hard copy of the report to each Chapter and Province Officer in attendance at the Province Assembly. Each Chapter will also be responsible for an oral presentation of said report to be given within the time limit set by the Host Chapter or Satrap.
Sec. 5 In addition to those duties pursuant to By-Law VI, Sec 2, the Province Secretary-Treasurer shall, in all cases, obtain a receipt for any money expended, and shall provide a written Income and Expense statement as part of the reports of the officers at Province assembly.
Sec. 6 In addition to those duties pursuant to By-Law VI, Sec 2, the Province Secretary-Treasurer is authorized to pay the following from funds received from regular Province Dues:
a. The regular operating expenses incurred by the Province and approved by the Province Assembly, or by the Executive Committee.
b. Special expenses of the Province as approved by the Province Assembly or by the Executive Committee.
c. The Grand Council Convention Registration Fee and round trip automobile mileage to the Grand Council Convention site shall be paid to the Province Delegate or Alternate Delegate, regardless of means of travel, at the rate of twenty (20) cents U.S. per mile. Reimbursement shall not exceed four hundred fifty ($450) U.S. Fifty percent (50%) of the aforementioned reimbursement may be advanced up to thirty (30) days prior to the Grand Council Convention. The remainder of the reimbursement shall be paid only after the official report of the Province Delegate as described in, and pursuant to By-Law VIII, Sec. 2, has been accepted by the Province Secretary-Treasurer, or if the Delegate wishes to deliver said report in person, the balance of the reimbursement will be held until the report is given. The Delegate shall also have the registration fee to the Province Assembly waived if said report is given in person. This shall apply only if said delegate received no other re imbursement from the Grand Council Convention.
d. Officer and Delegate reimbursement as outlined in By-Law XIII, Ordinance 5, Sec 2.
e. Fees related to the printing of awards for excellence and/or improvement and for the Satrap, at the discretion of a simple majority of the Executive Committee.
Sec. 7 In addition to the duties stated in By-Law VI, Sec 3, the Province Executive Committee Officers shall submit a written report of activities over the previous year to the Province Secretary-Treasurer.
Sec. 8 In addition to the duties stated in By-Law VI, Sec 3, the Historian shall maintain the Province archives, make submissions to The Mask, and act as editor of the Province V Newsletter, to be distributed at least twice a year.
Sec. 9 In addition to the duties stated in By-Law VI, Sec 3, the Chaplain shall maintain the ritual props, and review on a yearly basis the chapter report forms submitted by each chapter for presentation at the Midyear Convention.
Sec. 10 In addition to the duties stated in By-Law VI, Sec 2, the Province Parliamentarian shall be informed of Robert's Rules of Order, shall bring a copy to all Province Meetings for the purpose of clarifying parliamentary procedures. In addition he / she shall periodically review the By-Laws, over-see the Legislative Committee, the General Assembly, and ensure the following of Robert's Rules of Order. The Legislative Committee shall accept and present new By-Law proposals to the Province as the need arises. New proposals shall be brought to, and discussed at Province assemblies.
Sec. 11 The Webmaster shall be in charge of maintaining the Province V web page which consists of posting bi-annual officer reports, monthly updates, and working in conjunction with the Historian to post photographs of Province V events.
Sec. 1 In addition to the standing committees as declared in By-Law VII, Sec 1, the Province shall have a standing Professional Projects Committee.
Sec. 2 All committees, except the Executive Committee, shall consist of one member from at least three (3) Collegiate Chapters as appointed at the discretion of the Host Chapter.
Sec. 3 The Regent of all member Chapters shall have a non-voting position on the Executive Committee.
Sec. 4 In addition to the duties stated in By-Law VII, Sec 5, the Executive Committee at their discretion may select certain chapters to receive awards for excellence and/or improvement if they deem necessary. The costs for such awards would be absorbed by the Province at the discretion of the Executive Committee.
Sec. 1 The Province V Delegate and Alternate Delegate to the Grand Council Convention shall be elected at the regular Province Assembly prior to the Grand Council Convention. In case no Province Assembly is held, a delegate shall be selected by the Executive Committee of the Province.
Sec. 2 At Province Executive Interim meetings held in conjunction with a Grand Council Convention, the Province Delegate shall attend in the capacity of a non-voting member. Should the Satrap and Vice Satrap not be in attendance at the Grand Council Convention, the Province Delegate shall act as Chairman pro-tempore (with vote) for the above stated meeting as well as any Province caucus.
Sec. 3 The duties of the Province Delegate shall include preparation of a presentation of Province V report to be given at the Grand Council Convention utilizing the current audio/video technology. The GCC Delegate and Alternate GCC Delegate shall be responsible to ensure all chapters of Province V submit proxy forms to the National Office for the Grand Council Convention.
Sec. 1 Additional items of business may be considered, or the order of business may be altered at the will of the Satrap and/or with the consent of the Assembly.
No additions to By-Law X
Sec. 1 In addition to Robert's Rules of Order - Newly Revised, the following House Rules will be observed:
Rule 1: Seating of the delegates at all sessions of the Province Assembly shall be in alphabetical order; Collegiate Chapters first, using the Greek Alphabet; Graduate Chapters next, using the English Alphabet; Province Officers and Parliamentarian at the head table.
Rule 2: At the beginning of each session, there shall be a role call of Officers and Delegates. Unexcused absence shall be cause for reduction or elimination of reimbursements, at the discretion of the Executive Committee.
Rule 3: Any Delegate wishing to speak on an issue, shall first seek and gain recognition of the Chair.
Rule 4: Professional decorum shall be maintained during all meeting, luncheons, and/or banquets; at all times those in attendance shall be properly dressed; no member will be admitted if either obviously intoxicated, or with bare chest or bare feet. There shall be no alcoholic beverages consumed and/or allowed in the meeting rooms during business sessions, nor will smoking be permitted.
Rule 5: The Host Chapter shall provide a Sergeant-At-Arms who will maintain order, and if necessary, remove individuals from the Assembly, at the discretion of the Chair.
Rule 6: Candidates shall leave the room while their opponents are making their election speeches.
Rule 7: At the beginning of each session, all cellular and/or paging devices shall be set to silent or vibrate mode or be turned off.
Rule 8: The above House Rules may be suspended by a two-thirds (2/3) majority vote of the Assembly.
Sec. 1 By-Law XII, Sec 2, shall be amended to require a two-thirds (2/3) vote of the Assembly to adopt an amendment to By-Law XIII.
Sec. 2 By-Law XII, Sec 2, shall be amended to require a two-thirds (2/3) vote of the Chapters responding within thirty (30) days after the mailing of the amendment to Chapters.
Sec. 3 Three copies of all amendments approved by the Province shall be submitted by the Province Secretary-Treasurer to the Grand Counselor for review by the Legislative Committee of the Grand Council.
